This Privacy Notice does not apply to information collected by any third party, including through any application or content (including advertising) that may link to or be accessible from the Website, unless otherwise noted.

IHL is receiving your Personal Information as part of the escrow process to ensure proper title is in place.  IHL may also be acting as a service provider to Century. In such cases, we may collect or receive Personal Information about or from individuals for the sole purpose of providing services to or on behalf of Century. In cases where we are providing services to or on behalf of Century, we do not share consumer information with third parties, other than (1) those with which Century has contracted to interface with the consumer application, (2) law enforcement or other governmental authority in connection with an investigation, or civil or criminal subpoenas or court orders, or (3) as otherwise set forth in this Privacy Notice. The privacy notices of Century shall apply to information collected by Century, including Human Resources.

Additional privacy notices and policies specifically developed and maintained for residents of California, Delaware, Oregon, Nevada, Vermont and the European Union are entitled with the name of the jurisdiction and found near the end of this Notice.

Children Under The Age Of 18

Our Website is not intended for children under 18 years of age.  No one under age 18 may provide any information to, or on, the Website.  We do not knowingly collect personal information from children under 18.  If you are under 18, do not use or provide any information on this Website, register on the Website, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use.  If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information.  If you believe we might have any information from or about a child under 18, please contact us at contact@IHLescrow.com.

Personal Information We Collect About You On This Website And How We Collect It

We collect several types of personal information (“PI”) from and about users of our Website, including the following information:

  • From third parties, for example, our website management vendor.

Personal Information We Collect About You Outside Of This Website And How We Collect It

We collect several types of personal information separate and apart from this Website - from and about our customers and potential customers, including the following information:

  • Identifiers - name, postal address, e-mail address, social security number, driver’s license number;
  • Personal information categories listed in the California Records statute Cal. Civ. Code § 1798.80(e) - name, signature, address, social security number, driver’s license, government identification documents, telephone number, financial information, including lender approvals, referral information and prequalification information;
  • Characteristics of protected classifications under California or federal law – gender, marital status, past marital status, age and national origin;
  • Internet activity – IP address, information about your interaction with the Website;
  • Geolocation data;
  • Commercial information;
  • Total annual household income, whether you are working with a realtor, as well as their name, company, and e-mail, whether you are working with a lender to finance property, whether you are paying in cash;
  • As to realtors, first name, last name, office telephone number, e-mail address, street address, city, zip code, metropolitan location, and community;
  • Professional or employment-related information – employment information, present employer, type of business, occupation, salary and combined gross income;
  • Any additional information you provide to us, and;
  • Other personal information needed to provide title related services to you.

We collect this information:

  • Directly from you when you provide it to us;
  • From lenders and realtors;
  • By acting as a service provider to Century;
  • Through Century’s homebuyer survey;
  • From third parties, for example, our remarketing vendor (for geolocation).

Personal information does not include:

  • Publicly available information from government records.
  • Deidentified or aggregated consumer information.
  • Information excluded from the CCPA's scope, like:
    • Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data;
    • Personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver's Privacy Protection Act of 1994.

Length of Pi Retention 

We retain personal information for as long as needed or permitted in light of the purposes for which it was obtained and consistent with applicable law. The criteria used to determine our retention periods include: 

  • The length of time we have an ongoing relationship with you and provide our products and services to you (for example, for as long as you have an account with us or keep using our products and services);
  • Whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transaction or communications for a certain period of time before we can delete them); and
  • Whether retention is advisable in light of our legal rights (such as in regard to applicable statutes of limitations, litigation or regulatory investigations).

You are not required to provide any of this information, but if you choose not to provide certain information, we may not be able to provide you the requested service or complete your transaction.

We do not control third parties' collection or use of your information to serve interest-based advertising.  However, these third parties may provide you with ways to choose not to have your information collected or used in this way.  You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.

Data Security 

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls.

The CCPA provides consumers (California residents) with specific rights regarding their   personal information.  This section describes your CCPA rights and explains how to exercise those rights. 

Right to Opt-Out Of The Sale Or Sharing Of Personal Information (CA) 

IHL does not sell your personal information.  You have the right to opt-out of the sale or sharing of your personal information.

You have the right to direct to limit the use and disclosure of your sensitive personal information at any time (the "right to opt-out").  To exercise the right to limit the use and disclosure, you (or your authorized representative) may submit a request to us by visiting the following Internet Web page link: Exercise My Rights 

You do not need to create an account with us to exercise your limit use and disclosure rights.  We will only use personal information provided in a limit use request to review and comply with the request.

Please note that IHL can use sensitive personal information for the following purposes, and you do not have the right to limit the use and disclosure of sensitive personal information being used in the following ways:

  • To perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services.
  • To detect security incidents that compromise the availability, authenticity, integrity, and confidentiality of stored or transmitted personal information, provided that the use of the consumer’s personal information is reasonably necessary and proportionate for this
  • To resist malicious, deceptive, fraudulent, or illegal actions directed at the business and to prosecute those responsible for those actions, provided that the use of the consumer’s personal information is reasonably necessary and proportionate for this purpose.
  • To ensure the physical safety of natural persons, provided that the use of the consumer’s personal information is reasonably necessary and proportionate for this purpose.   
  • For short-term, transient use, including, but not limited to, nonpersonalized advertising shown as part of a consumer’s current interaction with the business, provided that the personal information is not disclosed to another third party and is not used to build a profile about the consumer or otherwise alter the consumer’s experience outside the current interaction with the business.
  • To perform services on behalf of the business, such as maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services on behalf of the business.
  • To verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by the business, and to improve, upgrade, or enhance the service or device that is owned, manufactured by, manufactured for, or controlled by the business. 

Right To Deletion 

You have the right to request that IHL delete any of your personal information that we collected from you and retained, subject to certain exceptions.  Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Right to Correction (CA) 

You have the right to request correction of inaccurate personal information maintained by us about you. Upon receipt of a verifiable request from you, we will use commercially reasonable efforts to correct the inaccurate personal information.

Response Timing and Format (CA) We endeavor to respond to a verifiable consumer request for access, correction or deletion within forty-five (45) days of its receipt, and a verifiable opt-out or limit use request within fifteen (15) days from receipt.  If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. 

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt, or after January 1, 2022 – as directed by you. The response we provide will also explain the reasons we cannot comply with a request, if applicable.  For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.  If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. 

Personal Information Sales Opt-Out and Opt-In Rights for Younger Customers (CA) If you are 16 years of age or older, you have the right to direct us to not sell your personal information at any time (the "right to opt-out").  We do not sell the personal information of consumers we actually know are less than 16 years of age, unless we receive affirmative authorization (the "right to opt-in") from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age.  Consumers who opt-in to personal information sales may opt-out of future sales at any time.

Please note that you may only make a data access or data portability disclosure request twice within a 12-month period.

If you choose to contact us directly, you will need to provide us with:

  • Enough information to identify you (e.g., your full name, address and customer or matter reference number)); and
  • A description of what right you want to exercise and the information to which your request relates.

We are not obligated to make a data access, correction, deletion or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected information or is someone authorized to act on such person’s behalf.

Any personal information we collect from you to verify your identity in connection with your request will be used solely for the purposes of verification.  The verification we may request will reflect personal information that you have previously provided to us. Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information.

You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice.

Non-Discrimination (CA) 

We will not discriminate against you for exercising any of your CCPA rights.  Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services. 

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels.  Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects.  Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

For Nevada Residents: Nevada consumers have the right to opt-out of having their personal information sold.  A Nevada resident may, at any time, submit a verified request directing IHL not to make any sale of any personal information that IHL has collected or will collect about the consumer.  Contact information to make such an opt-out request can be found near the end of this Privacy Notice.  You may also be placed on our internal Do Not Call List by calling ((833) 256-4448) or by contacting us via the information set forth at the end of this Privacy Notice.

For Oregon Residents: We will not share your Personal Information with nonaffiliated third parties for marketing purposes, except after you have been informed by us of such sharing and had an opportunity to indicate that you do not want a disclosure made for marketing purposes.

For Vermont Residents: We will not share your Personal Information with nonaffiliated third parties, except as permitted by Vermont law, such as to process your transactions or to maintain your account. In addition, we will not share information about your creditworthiness with our affiliates except with your authorization.

Not Financial Advice

You acknowledge and agree that by providing you with access to and use of the Website, we are not providing financial opinions or advice on any of the matters discussed or included on the Website, and we will not be liable to any party for any act or failure to act relating to any information included on the Website. You further acknowledge that none of the information contained on the Website constitutes a solicitation, offer, opinion, or recommendation by IHL to buy or sell any security, or to provide legal, tax, accounting, or investment advice or services regarding the profitability or suitability of any security or investment.
